Frequently Asked Questions about Recovering Funds from Brokers

Answers from the specialist lawyers and financial law experts of Cyber Guard Legal to the most common questions about protecting investors' rights.

Dispute and Recovery Procedures

How does our recovery method work?

Our method is a comprehensive legal and financial procedure aimed at compelling the return of the client's funds from the resources of insolvent or unscrupulous financial organisations.

Unlike a classic bank chargeback, the procedure includes:

  • Legal documentation of the broker's breach of contract;
  • Engagement with acquiring banks and market regulators;
  • Work with cryptocurrency gateways and fiat transaction services.

The broker will not release my funds and demands payment of a tax or a "mirror account". What should I do?

Do not transfer any additional funds. This is a common scheme used by financial fraudsters to keep hold of clients. No licensed broker requires separate payment of fees or taxes to third-party accounts. All legitimate charges are deducted automatically from the withdrawal amount.

Is it possible to recover money if the funds were transferred to private individuals (P2P)?

Yes. Where money was transferred to the cards of private individuals ("money mules"), the provisions on unjust enrichment apply. We prepare a claim package and a court filing, which makes it possible to freeze the recipient's accounts and recover the transferred amount with interest.

Timeframes, Documents and Terms of Engagement

What documents are needed to start the recovery procedure?

For a legal analysis of your situation, you will need to provide:

  • A bank account statement / cryptocurrency transfer history;
  • Screenshots of your account with the broker (balance, withdrawal requests);
  • Correspondence with the company's analysts or support team;
  • The contract or user agreement (if available).

How long does the money recovery process take?

Timeframes depend on the payment method and the broker's conduct:

  • Pre-litigation settlement: 14 to 45 days.
  • Bank dispute (chargeback): 30 to 60 days.
